Abstrak:
This research aims (1) to determine the cause of the company'sofficials withholding diplomas from workers and (2) to find theefforts made in providing legal protection for workers againstcompanies that withhold diplomas reviewed from Law No.13 of2003 on Employment.This type of research empirical law is amethod of legal research that serves to see the law in a realsense and examine how the law works in the community. Thesamples in this study are the Labor Office, Cooperatives, andSMEs Bone Bolango, companies that withhold diplomas, andrepresentatives of the detained diploma workers by thecompanies. The results show the factors that cause companies towithhold workers ' diplomas due to (1) the employmentagreement contract involving the company and workers.Workers are required to comply with the contents of theemployment agreement as well as the responsibilities of workers,(2) As for legal protection efforts of workers against companiesthat withhold diplomas, the Labor Office can bridge the problemsbetween workers and the employer company to make a callbetween the two parties and make a clarification with bothparties in the mediation process. The recommendations in thisstudy are: (1) Labor Law must be improved by regulatingspecifically the legal protection of workers concerning thedetention of diplomas. (2) Workers should read and understandthe contents of the employment agreement regarding thedetention of diplomas carefully because the contents of theagreement can sometimes cause industrial relations disputes inthe future.
