Abstrak:
This research uses a type of empirical legal research, namely legal research that tries to see the law in its true sense and study how the law works in society.The research results show (1) The legal consequences for business actors who sell expired food are regulated in the Consumer Protection Law, namely Article 19 concerning Responsibility of Business Actors and Article 62, Article 63 concerning Criminal Provisions; and the Food Law, namely Article 143, which regulates the provision of compensation in the form of administrative sanctions and possible criminal sanctions (in the form of revocation of business permits). (2) The form of legal protection for consumers who suffer losses due to the circulation and trade of expired food is legal protection. legal protection that is preventive and repressive. If consumers do not receive responsibility from business actors for the losses they experience, then consumers can report it to BPSK. Consumer dispute resolution can be done through litigation and non-litigation.As for what is recommended (1) Business actors are advised to maintain the quality of the products they trade and be responsible for product safety and provide responsibility to consumers as a form of protection of cooperation between the two. (2) The active role of consumers is required to take repressive action against business actors who sell expired food through BPSK Gorontalo City, which can take the form of reporting to the Gorontalo Food and Drug Supervisory Agency.
