Abstrak:
This study aims (1) to find out the provisions of parking against the loss of consumer goods and (2) to find out the legal liability of parking managers for consumers who lose goods. This type of study is an empirical law, namely a legal research method that serves to see the law in real terms and examine how the law works in the community. The samples in this study are from the Department of Transportation, parking managers (parking attendants), and consumers who lose goods in the parking lot. The results of this study show that: (1) Parking provisions, namely if the lost goods belong to consumers at the parking lot, consumers (as parking users) should prove by having a parking ticket so that it can be used as a juridical basis because it contains the rights of consumers (parking users) in the event of a loss. Parking levies become the basis for parking attendants in supervising and guarding the goods belonging to parking users (consumers) and they will be careful after knowing the risk of liability imposed on them. (2) The legal liability of the parking manager is in the form of reimbursement of costs and partial reimbursement of costs, following theresponsibility of the parking manager for the loss of vehicles and/or consumer goods related to the existence of a standard clause of transfer of responsibility in the parking ticket. Parking managers must be responsible for compensating consumers whose vehicles are lost in the parking area managed by the parking manager because the parking manager is proven to have defaulted in the parking agreement. This study recommends that: (1) Parking attendants should be briefed before being assigned to the parking location regarding the obligation to provide parking tickets to parking users (consumers) and know the legal basis related to parking. (2) Government and private parking managers should cooperate with parking insurance to anticipate the loss of vehicles and/or goods in the parking area to ease when compensating consumers who lose vehicles and/or goods while parked in the parking area owned by the parking manager.
